TERMS & CONDITIONS — PHOTOGRAPHY SERVICES (BELGIUM)
1. Identity & Scope
These Terms & Conditions apply to all photography services provided by [Tigran Khachatryan / Tigran Media], established in Belgium, unless expressly agreed otherwise in writing.
They apply to both consumers (B2C) and professional clients (B2B).
2. Booking & Agreement
2.1 A booking is confirmed only after written agreement (email, message, or signed document) and receipt of any agreed advance payment.
2.2 These Terms are deemed accepted upon booking confirmation, advance payment, explicit written acceptance, or use of delivered images.
2.3 Any client conditions are rejected unless expressly accepted in writing by the photographer.
3. Pricing & Payment
3.1 Prices are quoted in EUR, excluding VAT unless stated otherwise.
3.2 An advance payment may be required to confirm the booking.
3.3 Unless agreed otherwise in writing, invoices are payable within seven (7) calendar days after invoice date.
3.4 Late payment automatically results in:
statutory late interest under Belgian law; and
a fixed compensation of €40 (B2C) or 10% of the invoice amount with a minimum of €75 (B2B).
3.5 Non-payment entitles the photographer to suspend delivery and/or usage rights until full payment is received.
4. Cancellation & Rescheduling
4.1 Client cancellation:
more than 7 days before the shoot: no charge (advance refunded if applicable);
between 7 days and 48 hours before the shoot: 50% of the agreed fee;
less than 48 hours before the shoot: 100% of the agreed fee.
4.2 Rescheduling is subject to availability and may be refused or treated as a cancellation.
5. Force Majeure
5.1 Force majeure includes events beyond reasonable control such as illness, accident, severe weather, equipment failure, governmental measures, or venue restrictions.
5.2 Neither party is liable for delays or failure caused by force majeure.
5.3 Payments already made remain due for work already performed.
6. Execution & Artistic Discretion
6.1 The photographer retains full creative discretion regarding style, composition, selection, and editing.
6.2 The client acknowledges the photographer’s portfolio as reference.
6.3 Unused or rejected images remain the exclusive property of the photographer.
7. Deliverables & Delivery
7.1 The number of final images is determined by the photographer unless agreed otherwise in writing.
7.2 Images are delivered digitally in JPG format unless agreed otherwise.
7.3 RAW files are never delivered unless explicitly agreed in writing.
7.4 Delivery times are indicative only and not of the essence unless guaranteed in writing.
8. Revisions & Complaints
8.1 One (1) reasonable round of minor corrections is included unless agreed otherwise.
8.2 Additional revisions or extensive retouching may be charged separately.
8.3 Complaints must be submitted in writing within seven (7) calendar days after delivery.
8.4 Subjective dissatisfaction (style, mood, personal taste) does not constitute a valid complaint.
9. Intellectual Property & Usage Rights
9.1 All images are protected by Belgian copyright law and remain the property of the photographer.
9.2 Upon full payment, the client receives a non-exclusive, non-transferable licence limited to the agreed purpose.
9.3 Commercial use, advertising, resale, sublicensing, or third-party distribution requires prior written permission.
9.4 Alteration, filters, AI processing, or third-party editing is prohibited without written consent.
10. Portfolio Use (Photographer)
10.1 The photographer may use images for portfolio, website, social media, exhibitions, and promotion, in compliance with GDPR.
10.2 Private clients may object in writing before the shoot where permitted by law.
11. Client Obligations
The client guarantees that:
all permissions, permits, and access are secured;
photographed subjects have given consent;
provided materials do not infringe third-party rights.
The client indemnifies the photographer against all third-party claims resulting from breaches of these obligations.
12. Liability
12.1 Liability is limited to the invoice amount of the affected service, except in cases of fraud, wilful misconduct, or gross negligence.
12.2 Indirect or consequential damages (loss of profit, reputation, or business) are excluded to the extent permitted by law.
13. Data Protection (GDPR)
Personal data is processed solely for contract execution, invoicing, and legal obligations, in accordance with GDPR.
14. Termination
The photographer may terminate the agreement immediately in case of non-payment, unsafe or abusive conditions, or breach of these Terms.
All amounts due remain payable.
15. Severability
If any provision is held invalid or unenforceable, the remaining provisions remain fully valid.
16. Applicable Law & Jurisdiction
Belgian law applies exclusively.
Disputes fall under the jurisdiction of the courts of the photographer’s registered seat, unless mandatory law provides otherwise.
